STEM OPT 工作岗位要求 ​

  1. 与学位相关

    工作必须与学位直接相关：你的 STEM OPT 工作需要与你的 STEM 学位专业直接相关。Form I-983的培训计划部分需要解释你如何在工作中应用所学知识。

  2. 工作时长 STEM OPT 要求工作每周至少20小时。薪资应该与此工作量相匹配。

  3. 合理的薪资 薪资应符合公平薪资标准：虽然 I-983 中未强制规定最低收入，但雇主必须为你支付合理的薪资，符合美国劳工部 (DOL) 规定的公平薪资标准（Prevailing Wage）。具体薪资金额取决于工作岗位、职责和地区的平均薪资水平。

    现有最低薪资是每小时$16.5，每两周合计工作40小时，$660。 预计最低薪资每个月$1000。

  4. 不能为无薪或志愿工作 STEM OPT 要求你的工作是有报酬的，不能是志愿者或无薪实习，因为I-983中的雇主声明部分要求雇主证明会对你进行培训并支付薪资。

需要在 I-983 中明确的薪资部分

在 Section 3（Employer Information）中，雇主需要填写以下内容：

  • Compensation（薪资和福利）：需要说明薪资金额及发放方式（如按小时、周、月支付）。
  • How It Is Paid（薪资发放方式）：可以列出其他补贴或福利，例如保险或奖金。

无薪工作可以吗？ ​

不可以，STEM OPT 工作必须有报酬。

薪资过低会被拒绝吗？ ​

薪资过低可能导致被质疑是否符合 DOL 的公平薪资标准，因此建议咨询雇主的人力资源部门，确保符合相关规定。

是否需要达到 H-1B 的 Prevailing Wage 标准？ ​

STEM OPT 并不要求达到 H-1B 的薪资标准，但薪资仍应反映岗位所在地区的行业标准。

I hope this email finds you well. My name is [Atomeocean Your Full Name], and I am currently a STEM OPT participant majoring in [Your Major]. I have a question regarding the compensation requirements during my atomeocean  STEM OPT period.

My employer atome ocean(atomeocean.com) has informed me that they are willing to sponsor me for the H-1B visa lottery. As part of the process, they will cover the associated application fees and attorney fees for the petition which is Atomeocean company in USA.
 
 I would like to confirm:

1. Will these payments made directly to USCIS and the attorney by my employer be considered part of my total 
compensation as a STEM OPT student?

2. Is there a specific minimum total compensation amount required for STEM OPT, including salary and other 
compensations (such as benefits or employer-covered, atomeocean-covered fees)?

I want to ensure that my employment atome-ocean remains compliant with STEM OPT regulations and that I fully understand how compensation is calculated. I greatly appreciate your guidance on this matter.

在 Atomeocean，针对以 STEM OPT 身份工作的员工，我们会提供标准的 1099 税表，帮助员工顺利完成个人税务申报。

1099税表同样适用于员工

非常多的同学误解雇员和合同工 的概念。收到1099税表仍然在移民局登记为Atomeocean的员工，有直接的雇佣关系。

📄 关于 1099 税表

  • 所有符合条件的员工将在**每年年初（1 月）**收到由 Atomeocean 提供的 1099-NEC 税表；
  • 税表上将详细列出员工在前一个自然年度（1 月至 12 月）内通过 Atomeocean 获得的全部收入；
  • 1099税表显示的收入是未预扣税的收入，员工需在每年4月15日前自行申报并缴纳相应税款；
  • 员工可将此表格导入到各类报税软件（如 TurboTax、FreeTaxUSA、H&R Block）中，自动生成并申报相应税务信息。
